Per the Windsor Gardens Barbecue Grills Policy and Denver’s Fire

A gas, charcoal or wood-fired grill or cooking appliance cannot be
used on any lanai in Windsor Gardens, and can only be used at
least 10 feet from a building. This applies to the decks and garages
of the townhomes as well.

UL listed electric grills are permitted for use on lanais.

Residents on the first floor can store a grill on the lanai with a one-
pound propane tank attached and another one pound tank stored
on the lanai.
„
„
Propane tanks are not allowed to be transported through the
buildings.
„
„
The fire code prohibits the use of any grill or gas fired appliance
on an enclosed lanai.
The new trend of food smokers falls under the same category as
barbecues. The use of wood, wood chips or pellets in an electric food
smoker is not allowed for use on lanais.
As with any policy, if you would like to make a change or a
recommendation, you are welcome to attend Policy Committee
meetings to voice your concerns.
POLICY PLATFORM

There seems to be some confusion as to where people may smoke
in the Windsor Gardens community. Along with the Association’s
smoking policy (see below) a few words of explanation seem to be in
order.
The Colorado Clean Air Act provides that smoking is prohibited within
common areas in public and private buildings and condominiums. It
specifically prohibits smoking in the common areas of multiple unit
residential, retirement facilities and nursing homes and in lobbies,
reception areas, hallways, elevators, restrooms, and common use
areas – public and private.
Here is where it gets tricky. The Colorado Clean Air Act provides
this prohibition to indoor areas and within a 15-foot radius outside
the main or front doorway
unless defined differently by local law
.
The Windsor Gardens Association policy (our local law) states the
following: “Therefore all common areas, including limited common
areas, of Windsor Gardens will be non-smoking areas.” What is a
common area in the Windsor Gardens Association? Every place in the
community
except for
:

inside your own personal unit (your lanai, however, is a limited
common area with no smoking);
ƒ
ƒ
your car;
ƒ
ƒ
the Denver streets; and
ƒ
ƒ
Denver sidewalks (that would be the sidewalk that is on the loop
as it is considered part of the city street).
These are the four areas where you may smoke in the Windsor
Gardens community.
I hope this clears up some of the confusion around where you can and
cannot smoke.

SMOKING WITHIN ASSOCIATION PROPERTY POLICY
The Colorado Clean Indoor Air Act (July 1, 2006) provides that
smoking is prohibited within common areas in public and private
buildings and condominiums. The Board of Directors has determined
that smoking in common areas constitutes a noxious and offensive
odor and is hazardous and unsafe for a majority of residents in the
